Service tax can be claimed

11 October 2014 Dear All,
I'm trading ready made software and company charged service tax+ vat on it but it is a ready made software and I'm selling it as it is with vat and without charging service tax. Please suggest me that can i take input of service tax.

11 October 2014 Dear Sir,

The credit is available when you are providing taxable service. No credit shall be taken.

For more clarity refer to SC judgement in the case of 'Tata Consultancy services v. State of Andhra Pradesh (2002) (178) ELT 22 (SC).
