i want to know that in contract 97% labour and only 3% material than it should be works contract? if no then how i can prove legaly.

there has to be sale and service both then only its works contract.........

The classification of service will depends on nature of service provided. If it immaterial on composition of material and labour component.

Actuly problem is cliant supply some nominal material and use classification say works contract ,,we charge full rate 12.36% but they not aggre with our classification and matter in court there is any notification or circular?
