Please inform the justification in applying Section 39(2) of CA regulation act.

justification is to control the quality and supply of chartered accountants in market to keep it in line with demand...this is very much a clause that professional courses have all over the world....anyways, the marks required to pass the exam are very low and don't reflect the standards of technical knowledge a CA should possess at the time of qualifying.
