12 August 2009 Is there any minimum loan amount for which charge with ROC to be registered or all the borrowings against company's assets to be registered.

12 August 2009 Hi Pankaj,

There is no minimum loan amount in company law for which charge with ROC to be registered.

Criteria whether a charge is compulsorily registerable or not is given in Section 125(4) of the companies act, 1956.

In section 125(4) a list of compulsorily registerable charges is given. Kindly refer the section 125(4).
