15 December 2009 Dear member i want to know that if a company is not filing its income tax return and Roc returns like 23AC, 23ACA and 20B so what are remedies to restart that company.

15 December 2009 Check company's master data in MCA Portal. If the status of the company shows'active', file all the forms so as to regularize the company. On the other hand, if the status shows as 'strike off' move a petition before the jurisdictional high court under section 560(6) of the Companies Act,1956 to reinstate the name of the company in ROC's register. If the company succeeds in the said suit, then file all the pending returns so as to regularize the company's affairs.
