06 June 2013 in case of work contract service reverse charge applicable if
service receiver is Business entity registered as body corporate located in the taxable territory.

Please refer below explanation,

1)“Business entity” means any person ordinarily carrying out any activity relating to industry, commerce or any other business or profession. Thus, Government, charitable organisation is not ‘business entity’.

2)Body Corporate – Company, LLP, Cooperative Society is Body Corporate – Firm, HUF, Trust is not ‘Body Corporate’ [Society registered under Societies Act is legally not ‘body corporate’].

SO REVERSE CHARGE APPLICABLE TO LLP

but to applicable reverse charge under work contract ,,servicer receiver is business entity registered as a body corporate

so reverse charge applicable in your case

if your company or llp
