ONE OF MY CLIENT HAS NOT FILED HIS RETURN FOR LAST 5 ASST. YEAR. I.E; HE HAS LAST FILED HIS RETURN FOR THE ASST. YEAR-2008-09. NOW CAN I UPLOAD THE RETURN FROM ASST. YEAR 2009-10 TO CURRENT ASST. YEAR. PLEASE SUGGEST

No you cannot upload return for Ay_2009-10 to current assessment year. Now you can Only Upload for Ay_2012-13 and Current Year 2013-14( Whose Online form yet to come).

Thank you for your valuable suggestion, But in the Income Tax Site under upload return the option to upload return from Asst. Year- 2008-09 is available. Then what purpose the option is been provided.

Good question! The option to upload returns for older assessment years like AY 2008-09 on the Income Tax e-filing portal is mainly meant for filing or revising returns that are still within the allowable time limit or for certain cases where the department allows uploading for specific reasons.
However, for most old years beyond the regular time limit (usually 1 year from the end of the assessment year for belated returns), the system may still show the option but filing such returns online will generally not be accepted or processed.
Here’s the key point:
Returns for very old assessment years (like 2009-10 and before) generally cannot be uploaded and accepted now online unless the department has specifically reopened or allowed it via notices or assessments.
For recent years (like 2012-13 onward), you can still upload returns within the prescribed time limits.
