04 May 2010 mr.X a cititzen of india went to canada for business purposes on 1.1.2004.he was never out of india in the past. during previous year 2004-2005,2005-2006,2006-2007,2007-2008,he has been in india for 100days every year. He retuned to india to settle here on 1.1.2009. what is mr. X residential status for the assesment year 2009-2010

09 May 2010 i differ. he is oridinary resident. he was in India for more then 60 days in P/y 08-09 and more then 365 days in 4 preceding years immediately preceding P/Y 08-09. so he is resident.
further he satisfied both the additional condition so he is ordinary resident in India.
