12 December 2012 sir ,
if assessee acquires 8 plots from same owner under different registry deed and he further constructed 3 floor on each plot..

these flats are for the purpose of further sale and assessee receive advance payments..

is he liable to service tax?
are these 24 floors covered in definition of residential complex???

12 December 2012 This service is already taxable as part of construction of residential complex service under
clause (zzzh) of sub-section 105 of section 65 of the Act and as part of service in relation to
commercial or industrial construction under clause (zzq) of sub-section 105 of section 65 of
the Act. This entry covers the services provided by builders or developers or any other person,
where building complexes, civil structure or part thereof are offered for sale but the payment
for such building or complex or part thereof is received before the issuance of completion
certificate by a competent authority.

12 December 2012 but sir i'm little confused in the definition of residential complex as per section 65(91a)

are these 24 floors covered under this definition?? ( main point of confusion= common area)
