WHAT HAS THE SUPREME COURT DECIDED ON THIS ISSUE ON 20.01.2011? IN OTHER WORDS WILL THE STAY ORDERED BY THE DELHI HIGH COURT PREVAIL?

Supreme court has given stay on the order passed by Delhi HC. So for now, Service tax is payable.

Supreme court vide its order in case no. 16960/2010 dated 10.01.2011, issued an interim stay on the Delhi High Court's stay order No.3398/2010 dated 18.05.2010.
This situation is continued to be in force till the Delhi High Court gives any final verdict in case # No.3398/2010.
So at present, Service Tax recovery on rent is applicable.
