08 January 2010 Yes, it is taxable. I am not in knowledge of any Supreme Court ruling on this.

08 January 2010 Legally it is leviable but the constitutional validity is under chellange in the Supreme Court. Matter is sub judice in the apex court on being Department has filed SLP against the Delhi High Court order in the matter of Home Retailer.
