Reliving letter

This query is : Resolved

18 April 2015 I am working in an MNC where notice period for leaving organisation is 3 months. on approval of manager, this period can be reduced with deduction of basic pay from salary for the period for which notice is not served.. but only if manager agree. now situation is that, my manager is not agree to short the notice period and asking to serve full three month else they will abscond me. if I am leaving company without serving full notice period and agree to abscond, can company still take any further legal action? can they hold my EPF & Gratuity?

18 April 2015 No legal action can be taken except deducting pay for the period for which notice is not served from the gratuity amount. They can't hold your EPF and Gratuity.
