Releif under section 89

22 June 2013 1)Is there any necessity to give any application to Assessing officer for claiming releif under section 89.

2) Also, if the assessee had not been filing the Income Tax return for the past 5 assessment years .i.e. for the years for which the arrears were received, since the tax liablity was NIL, can there be any deniability of releif under section 89?

26 June 2013 NO APPLICATION TO GIVE FOR RELIEF U/S 89

AND W/O FILING RETURN YOU CAN NOT TAKE ASSESS INCOME OF ASSESSEE

26 June 2013 Sir, but how can the assessee file the return for all the past assessment years now?

In the same query posted, Mr. Paras Bafna has suggested that the assessee will be entitled to the relief.

27 June 2013 if assessment already complete
then assessee can not file return

but you can file relief if income of past years is below then income not charging the tax .
