12 June 2013 ABC LTD HAS PAID SALARY BY CHEQUE BUT THIS EXPENSE CLAIMED IN XYZ LTD THROUGH JV, NOW FROM WHICH COMPANY WILL PAY PROFESSION TAX EITHER ABC LTD OR XYZ LTD, ARE THIS IS POSSIBLE?

14 June 2013 Actual employer, that is the salary related to the particular employee employed with which company, that company is liable to pay professional tax. transferring expenses through JV will not have any impact on that

17 June 2013 Ok but i have to think as per income tax scrutiny. As per my view professional tax should be deducted by xyz ltd. Actual employee is of the abc ltd but i required to claim expense in xyz ltd

17 June 2013 Not to get confused with 2 different acts, each act having the applicability & object is different.

As per your case employee in one company and working for other company and raising the debit note to that company. but Income tax act does not bother about your professional tax deduction happened where ever it is.

Also debit not can be raised for only salary expenses. professional tax is not expenses, deducted from employee and paying to the PT department
