Regarding TDS

20 November 2009 Dear Expert,

we are manufacturers of Cements,

and during the expansion of my factory we have imported some of the machinery parts from aborad and we paid some amount as port dues.

my question is to deduct the TDS on port dues paid?

treat this as urgent and let me know.

20 November 2009 IF THE COMPANY PAYS DIRECTLY TO THE PORT TRUST INSTEAD OF PAYING TO THE CHA, IS THERE ANY REQUIREMENT TO DEDUCT THE TDS ON SUCH PAYMENT TO PORT TRUST?

20 November 2009 payments to CHA other than payment for custom duty & other port trust charges, comes under the bracket of professional fees. For this you need to take the copies of payments done to port trust authority by the CHA.

So if the professional fees are going above 20K then you need to deduct the tds u/s 194J the rate is 10%

we paid some amount as port dues to the channai port authorities, for that TDS is required to be deducted or not?

21 November 2009 payments to PTA for custom duty & other charges does gives responsibility an assessee to deduct the tds.

So as far as my opinion is consern there is no need to deduct the tds.

Experts please correct me if i am wrong.
