Regarding SSI Exemption under Excise

Can an LLP get the exemption under E/N 8/2003 by using the brand name which is registered in the name of one of the partners of LLP?

In my views:
1. LLP is a separate entity from its partners.
2. Goods manufactured by manufacturer on which brand name of other is used, the same is not eligible for ssi exemption except for some specified cases.
Hence LLP won't be eligible.

Make an appropriate agreement with the partner to bring the brand as capital contribution and for exclusive use of the "Brand". The agreement should protect the interest of Firm and the partner both.
