Declared service is included in the definition of service provided in sec 65B(44).
Thus taxaxbility or no taxaxbility hinges on whether right to use has been tfd or not. If not tfd service tax is applicable else VAT applies....

but i have one more question please clear fly towards VAT & Service tax abatement scheme .
VAT being state subject there is no one answer and concerned VAT Act of State concerned needs to be referred to....
