30 September 2014 i want to konw regarding service tax on hiring of Disal Genset (with fuel) please confrim Service tax appliable or not if applicable what is the rate of % & also confrim if avaiable any Abatement Scheme

01 October 2014 As per Sec 66E(f) read with Sec 65B(22) of the FA, 1994 transfer of goods by way of hiring..... without transfer of right to use such goods is a declared service.

Declared service is included in the definition of service provided in sec 65B(44).

Thus taxaxbility or no taxaxbility hinges on whether right to use has been tfd or not. If not tfd service tax is applicable else VAT applies....

Hope this settles the issue.....

01 October 2014 No abatement in service tax is provided regarding hiring of DG Sets.. It prescribes abatement only for Renting of motor vehicle...

VAT being state subject there is no one answer and concerned VAT Act of State concerned needs to be referred to....
