Here’s what you can do if someone has wrongly mentioned your name as Tax Auditor in their ITR without your consent:
Steps to take: Send a formal letter to the Assessing Officer (ITO) of the concerned Income Tax Department informing them that you did not conduct the audit for that person, and that your name has been used illegally in his ITR. Send a copy of this letter to the Institute of Chartered Accountants of India (ICAI) for their information and necessary action. About sending the letters: Can you send the letter to ITO by email? Usually, a written letter (hard copy) is preferred for official records, but you may also send an email if the ITO office provides an official email ID for such correspondence. It’s better to follow up with a hard copy or visit the office if possible. To whom in ICAI should the copy be sent? Send the copy to the Secretary of your Regional ICAI office or to the Disciplinary Committee of ICAI. The Secretary’s contact details are generally available on the regional ICAI website. Additional suggestions: Keep a copy of all correspondence sent. If you get any query from ITO or ICAI, respond promptly. ICAI may initiate disciplinary proceedings against the person for misuse of your name. You may also consider a legal notice if the matter persists.
