24 March 2013 is it necessery to have paid Tax in order to claim refund in the event of non liability.

08 April 2013 Either you have paid or TDS has been deducted from you and there is no tax liability against the income earned by you then only the refund is allowed otherwise not because you have not paid to the government anything to allow you the refund.

I have understood your question and you want to know that in case of your return is below taxable limit the difference between the minimum taxable limit and you income should be allowed as refund but it is not like that.
