Refund of TDS

16 October 2009 Dear Sir/s,

If I am a Salary Employee and my TAX is Deducted from Salary,I want to Know that If my Company is not Filling Return from NSDL eTDS return but they Deposit all the Tax in SBI(NB),Can I get my TDS instead of this things ?

Pls help me urgently

17 October 2009 No you can't get the credit or refund of this TDS. Submission of TDS returns means giving the credit to the PAN of deductees.
SO claim or for the purpose of refund it is necessary that the deductor should deposit the returns with NSDL.

17 October 2009 you can get tds refund if your company is deposited the tax and you get TDS certificate from your company.

17 October 2009 If TDS has been deposited in Bank against your PAN and You get Form 16, You can get back your TDS.

18 October 2009 But Sir my Company is Deposit all collected tax from TDS in their TAN No.and if they do not file ETDS return how could they give my PAN.?

18 October 2009 Your company has to file tds returns, then only you can get the refund sought for.

If the amount of tds is huge then your assessing officer will issue notice to the company to know whether tds has been deducted or not and can request tds officer to issue notice to the company.

All depends on the amount of tds involved.
