10 January 2008 how to substantiate the status of a Foreign organisation as partnership when the company is LLC and the income tax returns of the same are not available as it got dissolveld.
please help this is to substantiate the incometax department for non deduction of TDS.

You are saying the foreign organisation as partnership and immediately using the word company. Which is correct?

What got dissolved?

Incometax returns are not available where?

10 January 2008 sorry,

it is a foreign organisation which has the status of LLC. so the Dept questions on the status. but when entered into transaction it was in the status of Partneship firm. this hapnd sometime in 1997 based on that we decided not to deduct TDS. but after sometime the same organisation got dissolved and formed a company. so we thought of proving the same by way of showing the tax returns of the US firm. but the records are not available as they need to maintain the same only for 7yrs..

think now i am clear.

pls help

03 October 2008 Why are you saying that you are not liable to deduct tax on a foreign
resident not being a company? Section 195 is for all foreign entities.
