One of our client is running a non profit association for welfare of society. Its an informal organisation which is governed by a Memorandum of Understanding(MOU). This MOU is written on plain paper with signatures of its President and secretary.
Now they want to apply for a PAN Card. What is the status of this body? Is this an AOP or BOI? Moreover how should it apply for PAN? will the MOU serve as Identity proof of the body?

1. You might be running a non-profit association, but for income tax purposes, it would be considered so only if you are exempted under Section 11.
2. therefore, it is advisable that you have a properly documented documentation of setting of the association.
3. PAN shall be as AOP in case of organized structure other than company or trust. However, absence of registered set up document, it may cause problem for tax exemption.

What should be done? I mean what legal form should be taken? Whether a trust should be formed or Society of any other ? Please suggest
