ONE OF MY CLIENT NRI HAS SOLD HOUSE FOR 20 LACS IN FY 2015-2016. IN THIS CASE THE BUYER HAS NOT DEDUCTED THE TDS AND ALSO NOT GOT ANY EXEMPTION CERTIFICATE. NRI HAS SAVING ACCOUNT IN INDIA IN WHICH THE SALE CONSIDERATION IS KEPT. NOW THE NRI WANTS TO REMIT THE FUNDS TO HIS COUNTRY CANADA. NRI IS HAVING PAN NO AS NRI STATUS. AFTER COMPUTATION THERE COMES CAPITAL LOSS ON SALE OF ABOVE HOUSE. MY QUERY IS THAT NOW WHICH PART OF FORM 15 CA BE FILED ONLINE. SECOND ONE HE IS HAVING SAVING INTEREST INCOME ONLY AMT. TO 50000/- WHICH IS BELOW THE TAXABLE LIMIT. WHETHER HE HAS TO FILE INCOME TAX RETURN AND IF YES WHICH FORM TO BE FILED. THIRDLY HE IS IN CANADA AND DIGITAL DSC HAS NOT BEEN OBTAINED. PLEASE LET ME KNOW THE STEP WISE PROCESS FOR THE WHOLE. AND WHETHER HE TO COME TO INDIA FOR THE SAME OR CAN DO AT CANADA BY GIVING AUTHORISATION LETTER TO ME FOR THE SAME.

Pay the tax in India. Show it to the certifying CA. The CA can then issue the 15CB.
He can obtain DSC, no issues.

you can file itr-2 return. and take form form ca for trasfering the fund to canada.
