This query is : Resolved

06 May 2013 Dear Sir,

I am working in nepal and my company has transfer my salary in my account in india. Now let me clear ,

1- is my income is tax free in india, which i am geting salary in nepal but it is transfered in my indian a/c by company.

2- Can i mention such salary in my return as income from salary in other country? is my all income which is earning in nepal is tax free in india??

3- Can i get any tax benifit if i will transfer my salary my self in my indian bank account? and if the company will transfer my salary, can i get any tax benifit ?

06 May 2013 I presume you will be non-resident in India.

Income which is received in India is also taxable in India, hence though you salary pertaining to service in Nepal, if it is credited in India - IT Authority might ask it is taxable in India on this principel

However in case of salary, it is always taxable in the country where you are working. So it is always better that you recieve salary in Nepal and thereafter you remit the same to India so no question is being raised for taxability of the same.

As your income is not taxable in India, no question of obtaining tax benefit arises.
