NOW CAN WE FILE INDIVIDUAL RETURN FOR A. Y. 2013-14 WHENEVER TAX FREE INCOME ?? FOR GETTING REFUND. IF I HAVE ALREADY FILED RETURNS FOR A. YEAR 2014-15 & 2015-16. OUR INCOME FROM U/S 44AD CONTRACTUAL BASIS.

26 February 2016 You can not file Ay 2013-14, year is lapsed for filing return.

26 February 2016 No you cannot file ITR for A.Y. 2013 - 14 because the time for it lapsed on 31st March 2015. However, it appears you are interested in filing the return to claim refund of Tax Deducted at Source. If the amount of TDS refundable is less than Rs, 10 lacs, you may file a petition for condonation of delay in filing the ITR with the jurisdictional CIT / Pr. CIT under section 119 (2) of the Income Tax Act, 1961. if the amount exceeds Rs.10 lacs the petition is to be filed with the Chief CIT.

Mere filing of the petition does not automatically condone the delay. It has to be pursued and an order taken from the CIT / Pr. CIT / Chief CIT. However, you file may the belated return enclosing a copy the application for condonation u/s 119 (2) with your jurisdictional officer. However the refund will be issued only after the disposal of the petition u/s 119 (2).
