Non payment of TDS on Contractor.

I have not deducted TDS on contractor not paid to govt. in the year 2008-09. And this expenses is disallowed in the year 2008-09.
My question is now at what rate we should deduct TDS, what is interest, What is penalty, and this expenses will be allowed in the current year i.e.2009-10.
Pl guide.

Deduct @ applicable in the year 2008-09 and expenses will be allowed in the year of payment of TDS

Thanks for the reply. I would also like to know about penalty. At what rate I have to make payment of penalty and It will be great help to me if you can tell under which section I pay tds of last year and get expenses allowed in the current year.
