my client has got a letter from ITR for not filing returns of FY 2009-10 n according to CIB he has share transactions of Rs.20000 & above. when i got P&L statement of his share transactions from his broker it shows a loss of Rs.70000. Shud i still file the return?

Since notice has been issued,need to file the return even loss also.
