Need to know about service tax

24 December 2013 i have booked a Duplex flat in shrishtinagar Asansol project 2 years ago(in sept 2011). But till now they have not started construction , now on cancellation request they are telling that , i have to bear a loss of service tax.

My Question is Why i will pay service tax for that which is not yet started. But the company is not replying me since 4 months, I have made a cancellation request for that.
CAN YOU PLEASE HELP ME OUT I AM A ENGINEERING STUDENT. I dont have good knowledge in this.

One of my friend persuing CA , he told me that there is nothing like to pay SERVICE TAX ON BOOKING DUPLEX In ADVANCE.

24 December 2013 yes your friend is right and you dont need to pay any service tax in this scenerio.

you should ask for refund of service tax amount paid inn advance.

25 December 2013 Thank you tushar for replying me, but the problem is i dint have idea whether they(shrishtinagar asansol company) have paid that tax or not but they are keep saying that i have to bear a loss of that. CAN I ASK THEM FOR THE SERVICE TAX NUMBER....? after That, What should i do with that Service tax number...? Or simply they are lying...? May be they haven't paid Stax...simply lying...?

I have all ready in loss by dealing with this COMPANY.. They actualy even not giving me response.. PLS PLS REPLY.. M waiting for response..

25 December 2013 you dont need to go in this matter u can take helkp of any ca or advocate and given them notice of refunding the servcie tax as there is no servce tax to be payable by you.
