Motor car sale

Under Maharashstra vat rule 54 set off is not allowed on passenger motor vehicle. So if I purchase a car i pay tax to motor dealer but i dont get a set off. do i have to pay full tax @12.5% when i sale the same car?

It is only 5% for used motor cars....mjk
