Less tds deduction

we are receiving rental income of rs.45000 per month. Tenant has deducted tds for 9 months forgot to deduct for 3 months of 2013-14. Is there any penalty on us or on tenant. If on tenant what is the penalty.

You may disclose this total receipt in your income tax return and pay balance tax/claim refund, as the case may be.
