Leaves during articleship

30 May 2014 Dear sir/Madam,
i am a ca final student completed my
1 year & 7 months of articleship. due to some
issues i have taken transfer from previous employer ,my principal mention 195 days of leave on form 109. i was registering for articleship from 29/10/2012 to 29/10/2015,accordingly my final attempt due in may 2015,but due to excess leave for which attempt i am eligible whether Nov 2015 or May 2016?.please reply asap i need proper guidance -abhishek ,new delhi.total leaves taken 195 till 27 may 2014.articleship period 29/10/2012 to 29/10/2015.....helpppppp meeeee

30 May 2014 stitch in time.......what is the period put by the new employer....second principal in your form? Assuming it to be 29/10/15, you can take the May 2015 attempt. (A fair vcourse would have been, however, after getting transferred...the new employer should have taken cognisance of excess leave and accordingly should have put the same in articleship deed)

30 May 2014 dear amol sir new employer put any date after getting transfer from previous employer.....i.e i got terminated from previous employer on 26 may 2014.the new employer put any date after 26 may as per my consent

30 May 2014 Amol ji...laeves of 195 days already mentioned in my form.....this is the problem....is there any way to save my attempt the rest articleship period covered after my exam

30 May 2014 sorry to say.....that was not what is expected out of Principal..... Anyway what has happened has already taken place....let us not worry about the same.....u got the letter from ICAI? the dates as given by you are the same as ICAI has allowed you? then u can appear for May 2015

30 May 2014 See Abhishek, if u have the letter from ICAI stating the period of your articleship as 29/10/2012 to 29/10/2015......nothing to worry...u can appear for May 2015. The excess leave if any is required to be served after 29/10/2015.

30 May 2014 yes sir i was requested so many times to my principal,but he is not considering..the date is same of termination i.e.26 052014,institute has given the same date as my leaves already exceed maximum leaves can i still appear for may 2015...plzzzz replyyy amol ji

01 June 2014 Dear Abhishek,

ICAI guidelines are pretty clear. you need to complete articleship including excess leave on or before 30 October to be eligible for May attempt. In your case because of leaves already reported, you wont be able to complete articleship before 30 october and accordingly, you should not be eligible for May 15. please note Form 103 signed with new principal wont be the final document for articleship completion but the ICAI records.
