The Service Tax Return could not be filed due to problem with the ACES software. The assessee filed paper return citing its inability to file the return electronically. Afterwards, after removal of the error with the software and advice of the department, return was filed electronically, albeit after the due date.
Whether the assessee is liable to pay late fee in the above circumstances ?

If you have you filed the return manually before the due date then the late fee would not arise.
