Is their any provision to waive off penalty,levied Notice U/s 274 read with 271BA for non filling of form 3CEB as required u/s 92E .....???

The penalty is not a mandatory one.
You shall be given an opportunity to explain the reasons for non-filing of 3CEB.
Refer to cases:
If bonafide reason for non-filing is there:
136 TTJ 629, 138 TTJ 254,288 ITR 289
If no reason given, penalty may be levied: 145 TTJ 94
