Input Tax Credit on Capital Goods

14 March 2009 Can someone clarify me that if some goods are purchased which are capital goods as per Excise and it is through Vat invoce Input Tax Credit Can me claimed or not? If Yes, then Why ?

14 March 2009 As per Rule 9 of Central Excise Rules' 2002, You can claim Input Credit only through the documents specified therein.

If you want to claim CENVAT of CG through an Invoice then all the conditions of invoice as specified in Rule 11 of CER' 2002 should be met.

In your case, since yours is a VAT invoice, still if it contains all the particulars of Rule 11, then you can book the credit & thereby utilize it in the manner specified in Rule 3(4) of CCR, 2004.
