24 November 2008 we are paying service tax on freight , the same can we claim in er1 return , some of transporters not collecting service tax in that instance we need to pay tax our self.

24 November 2008 You can pay service tax on freight & cartage on 25% and take cenvat credit

Cess s&H on service tax Dr

but no cenvat credit on outward cartage

24 November 2008 To Ram Avtar Sir, i think we cannot take credit of freight because as per the amendment by finance act 2008 GTA is excluded from the definition of out output service. Further in the definition of input service as far as outward transportation is concerned it is only upto place of removal and not from place of removal therefore in my view credit cannot be taken. correct me if am wrong.
