02 January 2010 The company has not taken the input of service tax on the services taken by it during 2008-09.The service tax return has also been filed with the department. Can input of service tax be claimed in 2009-10? Please suggest. Is there will be need for filing revised return and also suggest if the original return was filed before 6 months ( i , e we will not be able to revise the return).Pls advise.

03 January 2010 YES,input of service tax 2008=09 can be claimed in 2009-10.
you can not file revised return because return file time limit is sixty days.

04 January 2010 If you filing return for the current period you can show the what ever credit available as on the date on which service tax is payable. Suppose the ST is payable by 5th of Jan means, what ever the credit available or accumulated upto 31st December 2008 can be taken and utilised for payment.
