Dear All
Can any body tell me that whether service tax credit is allowed on the mobile reimbursement to employee.
For example, if company reimburse 1000 Rs. per month to a employee , whether servie tax credit is allowed ,it is specially note that mobile phone bill is in the name of employee only not in the name of company.
If yes the please attach any such clarification OR notification by deptt.

Very often ST on mobile bill were denied on the ground that the assessee has not been able to substantiate thet the calls has been made for business purpose only and has not been used for personal purpose.
The judiciary is also divided on the issue.
