Input credit in case of commercial contracts

This query is : Resolved

08 May 2009 Hi Friends,
My client is a civil contractor and providing services of commercial contracts. As per the rules, he can claim abatement of 67% of the value of contract. My query is, whether he can claim CENVAT credit of input services e.g. telephone and audit fees if he claims abatement also.

08 May 2009 No he would not be entitled to avail credit on capital goods, inputs and input services. Prior to 01.03.2006,service providers availing 67% exemption could avail credit on input service but not any more.
