04 February 2014 Cenvat input service for General insurence on commercial motor vehical like truck lorry is allowable or not. The excise audit team has disallowed it during auditing on the ground that it is allowable only to motor manufecturing unit. Dear expert pl comment.

04 February 2014 They are correct,because,As per Service Credit Rules,to avail any credit of an input service,both the output and input services should be of same category under clause (105) of Sec65 of The Finance Act1994.Like a advertising agency may employ the services of a photographer sound recorder or a painter,but the ST paid by them can not be availed as an input service,as they are of different categories......mjk
