20 January 2012 One of my friend has not filed return since 3 year. E file of return for the A.Y. 2009-10 and afterwards is pending. How to file return for 2009-10 and what is the panelty and how to deal with the further process?

20 January 2012 He can file his return for AY 2010-11 and AY 2011-12.

In case his income is taxable for the AY 2010-11( i.e. for Financial Year 2009-10), penalty may be levied. In case the income is not exceeding the taxable limit, he may not be liable for penalty. However, it is a discretionary matter and depends upon the AO.

For AY 2011-12, he can file return.
