20 January 2012 one of my Client is not Registered with Service Tax and his annual receipts crossing more than 10 lacs and he wants to file IT return claiming refund of Rs 1.5 lacs.. can he do so or any scrutiny will come from excise office

21 January 2012 As per Notification No. 26/2005 "Any provider of taxable services whose aggregate value of taxable services for all taxable services and from all premises in a financial year exceeds 9 lakh rupees" is required to take registration. It is in respect of taxable services if you turnover exceeds 9 lakhs you are required to take registration and pay tax if turnover exceeds Rs. 1o lacs. But if your non taxable is more than Rs. 10 lacs, you are not liable to take registration. Therefore, dont worry about if your turnover is more than Rs. 10 lacs. There is no possibility of any scrutiny from excise office.

23 January 2012 he is providing man requiting service which is taxable service and he is registered service provider but he not filled any ST return,,,,
