Income tax refund

30 October 2012 Dear All,

The CIT-Appeals has passed an order in favour of the assessee and has ordered the ITO to issue the refund due to the assessee. Now the Revenue has gone into ITAT appeal. THe ITO has not filed any stay order for grant of Refund. Should the Refund be remitted to the assessee as the Revenue has not filed any appeal?

30 October 2012 Ofcourse YES. The practical part of the story is that you need to push the concerned assessing officer... needs to make a good follow up with the assessing officer.
