Income of minor taken twice in a/c

Sir for the accounting year 2008-09 By technical mistake ,the income of my minor son calculated twice in my account,although the computation is correct. The refund did not came. i met the AO and given a written request with all the related documents. But she did not taken the matter seriously & sent an order under section 154 in Nov. 2012. I had not made an appeal.Now some one advised me to file an appeal to CIT. Is it possible to file an appeal to CIT ? Please advise . Sanjeev Malhotra

Can file appeal before the CIT (Appeals), along with a 'condonation pettion' for the delay in filing the appeal.
