I have one query regarding status of HUF. Can HUF continue after the death of the only male member of the family? Can there be a HUF without male member? Can wife become karta of the family in place of her deceased husband? Please reply.

23 April 2009 Only a male member can be a karta of a HUF. Even a one day boy is there in the family then HUF can be continued. The gaurdian of boy will be deemed karta until he attains majority. In this case a lady member can be a gaurdian of the boy and she can manage the HUF. However if only females are there and no male member exists then automatically the HUF should be closed and the funds should be tranferred to female members. A lady member cannot be a karta of a HUF.

In my opinion,

As long as the property which was originally of the joint Hindu family remains in the hands of the widows of the member of the family and is not divided, HUF can continue with female members.

28 April 2009 Even after death, so long as the property which was originally of HUF remains in the hands of widows and is not divided among them, the joint family continues.
