A proprietor of a business dies suddenly without leaving a will. He is survived by a Wife and married son. Can business of the deceased be thrown into property of son's HUF after obtaining Mother's NOC. The son's HUF will be formed now.

If there is no will, then the son will automatically become legal heir of his business (if he is the only son). The proprietorship will not get transferred to HUF, but the son will act as legal heir.
