GST implication of Sale of Web Series to OTT platform.

This query is : Resolved

Quick Summary
When a production house sells a web series to an OTT platform, it's generally treated as a supply of software or Online Information Database Access and Retrieval (OIDAR) services. This typically incurs a GST rate of 18%, regardless of whether Input Tax Credit (ITC) is claimed. The key is that it falls under the supply of digital content rather than a simple IP right transfer.

09 March 2020 A sole proprietorship production house is planning to sell a web series to any OTT platform like Amazon Prime.
Should it be treated as Transfer of Intellectual Property (IP) right in respect of goods other than Information Technology software and charged at the rate of 12% GST

If not Please tell the correct GST implication of the same ??

09 March 2020 No, it will fall under software transfer.

GST Rate for IT Services (Software) Single GST Rate for IT Software: GST rate for all kinds of IT Software supply: services, products, supply on media, electronic download and temporary transfer of Intellectual Property (IP) is 18% with full Input Tax Credit(ITC).

09 March 2020 What if the assessee doesnot want to avali ITC ??

09 March 2020 Online supplies of Digital Content (Music, Movies, Television Shows, etc.) are known as OIDAR i.e. Online Information Database Access and Retrieval services. GST @ 18% i.e. the Service Supplier should be registered in India and shall collect GST@ 18% from the Service Recipient.

09 March 2020 No problem in case ITC not availed.

09 March 2020 Thankx a lot sir for your guidance.

10 March 2020 Welcome...............
