27 July 2024 Under GST, Input Tax Credit (ITC) is available on most goods and services used in the course or furtherance of business. However, there are specific provisions that need to be considered when determining the eligibility of ITC for certain items.

### **Eligibility of ITC on Shoe-Covers:**

**1. **Usage in Manufacturing:**
- **Shoe-covers used in manufacturing industries** are typically considered as part of the operational requirements for cleanliness and safety in a production environment.
- As per the GST law, ITC is available on goods and services used for the furtherance of business operations. Since shoe-covers are used to maintain cleanliness in the production plant, which is part of the manufacturing process, they are generally eligible for ITC.

**2. **Section 16 of the CGST Act:**
- **Section 16(1)** of the CGST Act allows a registered person to claim ITC on inputs, input services, and capital goods used in the course or furtherance of business.
- **Section 16(2)** provides that ITC should not be claimed on items that are specifically blocked under Section 17(5) of the CGST Act.

**3. **Blocked Credits (Section 17(5)):**
- The section specifies certain items where ITC is not allowed, such as motor vehicles (with certain exceptions), goods and services used for personal consumption, and certain other categories.
- Shoe-covers used for maintaining cleanliness in a manufacturing setup do not fall into the categories of blocked credits. Therefore, ITC on shoe-covers used in a manufacturing facility should generally be allowed.

### **Relevant Notifications and Rules:**

**1. **CGST Act and Rules:**
- The general provision for claiming ITC is under **Section 16** of the CGST Act.
- **Section 17(5)** details the circumstances where ITC is specifically blocked.

**2. **GST Guidelines:**
- There are no specific guidelines or notifications that exclude shoe-covers used in manufacturing from ITC. Hence, they are generally considered eligible for ITC.

### **Practical Considerations:**

**1. **Documentary Evidence:**
- Ensure you have proper invoices and documentation to support the claim for ITC. The invoices should clearly mention the GST amount charged.

**2. **Proper Accounting:**
- The purchase of shoe-covers should be accounted for in the input credit ledger correctly, and the GST should be reflected accurately in the GSTR-3B return.

**3. **Internal Policies:**
- Check your internal accounting and GST compliance policies to ensure that ITC on such items is claimed correctly and in compliance with the GST laws.

### **Conclusion:**

You should be able to claim ITC on the GST paid on shoe-covers used in the manufacturing process, given that they are used for cleanliness and operational purposes within the factory. Ensure that all documentation is in place and that the claim is supported by proper invoices.

For any specific queries or clarifications, you might also consider consulting with a GST practitioner or tax advisor to ensure compliance with the latest GST provisions and any specific industry guidelines.
