In your case ROC has not pointed out resubmission due to similarity in names, So ROC might approve this name but it will be the sole discretion of ROC.

apostrophy in the name is not allowed, submit fresh names Form should be resubmitted by 20/04/2014 failing which the eForm shall be treated as invalid and shall not be taken on record. (Please refer Regulation 17 of the Companies Regulation, 1956)

In my opinion your name without apostrophe might be approved as ROC has not pointed out similarity in name with existing company.
