11 June 2011 Dear Friends / Expert,

Please see my basic query.

ABC Pvt Ltd is yet to file e-tds returns for the 4th qtr.

Due to urgency, the company has to issue immediately Form 16 to its employees.

Query

Whether the company can issue Form 16 without filing e-TDS returns.(The company has promptly made tds remittances to govt before the due date).

Ans :.................

Please advise with any related cbdt circular / notification for me to understand.

12 June 2011 Whether the company can issue Form 16 without filing e-TDS returns.(The company has promptly made tds remittances to govt before the due date).

Form 16 Requires Challan identification no and Receipt No of quarterly e-tds Return.
In this case, in Form 16, these details could not have been given.

Inform the concerned employees to surrender the earlier Form 16 to get it replaced with the proper form 16.

12 June 2011 The company can issue Form 16 without filling of TDS return but you should have to mention the fact that the company have not filled TDS return.
