20 May 2012 employee received salary p.m rs 12000 in cash from employer without deducting tds b'coz total salary does not exceeds the maximum amt chargeable to tax.and employer had not filed tds return for same reason ..now employer refuse to issue form 16 .. so it can be possible to filed income tax return without form 16 with showing salary income in form 1 sahaj...??????
plz give rpl its urgent .......

20 May 2012 As per the Income Tax Act, 1961, Form 16 is to be compulsorily issued to only those employees who TDS was deducted in the year. For other Employees whose TDS was not deducted during the year, it is at the option of the employer to issue Form 16 or no.

Why cant Income Tax Return not be filed without Form 16. Income Tax Returns can very well be filed without Form 16. Just collect all your Salary slips for the various months and summarize the amount of Salary received in various categories viz. Basic, Educ All, Convy All etc. to claim the benifit of the various allowances and file your Income Tax Return.
